1. Agreement to Terms

By accessing or using the website of Xcode Technologies (“we”, “us”, “our”) at xcodetechnologies.com (the “Site”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site. We may update these terms from time to time; your continued use after changes constitutes acceptance of the revised terms.

2. Use of the Website

You agree to use the Site only for lawful purposes and in a way that does not:

  • Infringe the rights of others (including intellectual property or privacy).

You may view and print pages for personal, non-commercial use only, subject to these Terms.

5. Submissions and Contact Form

When you submit information through our contact form or otherwise (e.g., project ideas, feedback), you grant us a non-exclusive, royalty-free, worldwide license to use that information to respond to you, provide services, and improve our business. You represent that you have the right to provide such information and that it does not violate any third party’s rights. We do not treat such submissions as confidential unless we have agreed in writing to do so.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XCODE TECHNOLOGIES, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED INDIAN RUPEES (INR 100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Xcode Technologies, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

The Site may contain links to third-party websites or services. We do not control and are not responsible for their content, privacy practices, or terms. Your use of third-party sites is at your own risk. We do not endorse any linked site unless expressly stated.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, India.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
